1. Acceptance & Scope
By accessing spaintravelguides.com (the “Website”), booking or participating in our tours and activities (the “Tours”), or subscribing to our emails (transactional and/or marketing) (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Services.
The Services are provided by Iberia Explorer S.L., Calle de Alcalá 123, 28009 Madrid, Spain, VAT ESB12345678 (“we”, “us”, “our”).
2. Defined Terms
- Website: our site at https://spaintravelguides.com/ and its subpages.
- Tours: guided excursions and related activities offered by us or our partners.
- Transactional Emails: booking confirmations, itineraries, invoices, service notices.
- Marketing Emails: occasional updates, news, seasonal offers sent with valid consent.
- Subscriber: a person who has provided valid consent to receive Marketing Emails.
- Mail Processor: Mailgun (Sinch), our email delivery vendor.
3. Eligibility
You must be capable of entering into a binding contract under applicable law to use the Services. If you are under the digital consent age in your country, you must have verifiable consent from a parent or legal guardian.
4. Bookings, Payments & Cancellations
Specific terms (pricing, inclusions, schedules, cancellation/refund rules) are disclosed during checkout or on your booking confirmation and prevail over any conflicting information on the Website. We may use reputable third-party booking/checkout providers; their terms may also apply.
You are responsible for providing accurate participant details and contact information. We reserve the right to deny participation where safety, capacity, or legal requirements so demand (e.g., intoxication, unsafe behavior).
5. Email & Newsletter Terms
5.1 Consent and Sources
- We collect consent primarily offline (paper or e-signature at our tour desk/partners/events) and via QR/messengers (WhatsApp/Signal/Telegram) with explicit written consent.
- When website forms are live, online opt-in will be available at
/subscribe.php. We never buy or rent email lists. - We keep consent logs with timestamp/IP/source and send a confirmation email.
5.2 Frequency & Content
- Approx. split: ~80% Transactional Emails and ~20% occasional Marketing Emails (volume may vary seasonally).
- Every Marketing Email includes a one-click unsubscribe link and our physical address.
5.3 Unsubscribe & Preferences
- You can unsubscribe at any time via the link in any email or at
/unsubscribe(when available). We process opt-outs promptly and in any case within 48 hours. - You may also request deletion or preference changes by emailing [email protected].
5.4 Delivery & Filtering
We use Mailgun (Sinch) as our mail processor. Email delivery may be affected by recipient server policies and third-party filtering; delivery is not guaranteed. We recommend that you whitelist our domain and check spam/junk folders.
5.5 Complaints & Abuse
If you believe you received unwanted email from us, contact [email protected] with the original message (including headers). We honor complaints, promptly suppress affected addresses, and maintain suppression lists.
6. Acceptable Use (AUP)
You agree not to use the Services to transmit, publish, or promote:
- Illegal content; malware, phishing, or deceptive practices;
- Harassment, hate speech, incitement to violence, or explicit adult content;
- Infringing content (copyrights, trademarks, privacy/publicity rights);
- Unsolicited bulk email (“spam”) or lists obtained without valid consent.
We may suspend or limit access if we reasonably suspect AUP violations, security incidents, or legal risk.
7. Data Privacy, Security & Processors

7.2 Security
We use appropriate technical and organizational measures. Email is not a fully private channel; avoid sending sensitive data over email. TLS is supported but not guaranteed end-to-end if a recipient’s server does not support TLS.
7.3 Processors & Transfers
We use Mailgun (Sinch) to send emails. Where applicable, appropriate safeguards (e.g., Standard Contractual Clauses) apply to international transfers.
8. Intellectual Property
The Website (text, photos, graphics, trademarks, and code) is owned by Iberia Explorer S.L. or its licensors. You may not copy, modify, or distribute content without permission. You retain rights in content you submit, but grant us a non-exclusive license to use it for providing the Services.
9. Disclaimers & Limitation of Liability
Services are provided “as is” to the maximum extent permitted by law. We do not warrant uninterrupted operation or error-free content. To the extent permitted by law, our total liability for claims relating to the Services shall not exceed the greater of EUR 100 or the total fees paid by you for the affected Tour, if any, in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.
10. Indemnification
You agree to indemnify and hold us harmless from third-party claims arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.
11. Changes to the Services or Terms
We may update the Services or these Terms from time to time. If changes are material, we will notify you prior to their effective date by reasonable means (e.g., website notice or email). Continued use after the effective date constitutes acceptance.
12. Governing Law & Disputes
These Terms are governed by the laws of Spain. The courts of Madrid, Spain, shall have exclusive jurisdiction, without prejudice to mandatory consumer protections under applicable law.

14. Miscellaneous
- Entire Agreement. These Terms plus the privacy notices form the entire agreement regarding the Services.
- Severability. If any part is unenforceable, the remainder remains in effect.
- Assignment. You may not assign rights without our consent. We may assign in connection with a reorganization or sale.
- Force Majeure. Neither party is liable for delays beyond reasonable control (e.g., natural disasters, outages).
- Language. For convenience, these Terms are provided in English. A Spanish version may be provided; in case of conflict, the Spanish version will control.
